1. Terms of Service
These Terms of Service ("Terms") govern your use of buildmodeaerial.ca (the "Site") and any inquiry or booking made through it, operated by Build Mode Digital Inc. o/a Buildmode Aerial Mapping ("Buildmode Aerial," "we," "us," or "our"), Ontario BIN 1001719291, based in London, Ontario, Canada.
By visiting the Site or submitting an inquiry, you agree to these Terms.
2. Booking Status
Buildmode Aerial Mapping is open for booking. Rates published on the Site are current flat-fee rates in Canadian dollars, before HST, for work within 45 km of London, Ontario; travel beyond that is quoted with the job. Published rates are indicative until confirmed in a written quote for your specific site and scope.
- Submitting an inquiry or booking a sample flight is free and does not create a contract or obligation to purchase services.
- No service is rendered, and no fee is owed, until both parties agree to a written quote or service agreement specific to that project.
- The free sample flight is a sample of output quality and format, not a deliverable: it does not include a full-site map, volumes, or measured quantities.
- Rates may change. The rate quoted to you in writing governs, not the rate displayed on the Site on any later date.
3. Services
Buildmode Aerial Mapping provides aerial documentation and measurement services for contractors, developers and yard operators — construction progress documentation, stockpile volume reporting, pre-bid site capture, earthworks cut/fill comparison, as-built documentation, and roof and asset inspection. Deliverables are produced by photogrammetry and carry a photogrammetric methodology note; they are not a legal survey and are not a substitute for work reserved to an Ontario Land Surveyor. Video, FPV and documentary production is a separate service offered at buildmode.studio. Specific services, pricing and scope are defined in a written quote or agreement for each booking.
4. Drone Operations & Regulatory Compliance
Drone (RPAS) operations in Canada are regulated by Transport Canada. Operations are flown by Build Mode Digital Inc. o/a Buildmode Aerial Mapping under RPAS Operator Certificate OC2623804121 (CAR 901.214), against a written operations manual, by a pilot holding an Advanced RPAS pilot certificate. Liability insurance is in place (see Section 5).
- All flights will be conducted in compliance with applicable Transport Canada rules, including airspace restrictions, altitude limits, and any required notifications or authorizations for the specific site.
- Clients are responsible for disclosing any site-specific hazards or restricted airspace conditions they're aware of (e.g., proximity to airports, power lines, or restricted zones) prior to a booked flight.
- We reserve the right to decline or reschedule a flight for safety, weather, or regulatory reasons.
5. Liability & Insurance
Build Mode Digital Inc. holds commercial general liability and aviation liability coverage bound at $2,000,000, with limits increased per engagement where a client contract requires it. A Certificate of Insurance is provided before shoot day as part of any service agreement, and on request during prequalification.
To the fullest extent permitted by law, our liability for any claim related to services will be limited to the amount paid for that specific booking, and we will not be liable for indirect, incidental, or consequential damages.
6. Intellectual Property & Footage Use
Ownership and usage rights for footage and final deliverables (who can use the video, for what, and whether Buildmode Aerial Mapping can use it in a portfolio or on social media) will be defined per-project in the written service agreement at time of booking. Until that agreement exists, no footage-related rights are implied by visiting this Site or joining the founding-client list.
7. Governing Law & Changes to These Terms
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
We may update these Terms from time to time, including as Buildmode Aerial Mapping's entity structure and licensing status change. We'll update the "Last updated" date above when we do.
8. Privacy Policy
This section explains what information we collect through the Site, how we use it, and your rights regarding it.
8.1 What We Collect
- Email address (and name, if provided) — when you join the founding-client list or submit an inquiry.
- Project details you share with us — if you describe a project or job site when reaching out, e.g., via aerial@buildmode.ca.
- Basic technical data — standard web server logs collected automatically by our hosting provider for security and performance purposes.
8.2 How We Use It
- To reply to your inquiry, send scheduling and project correspondence, and share occasional work updates if you've joined the founding-client list
- To respond to your inquiry and scope a potential project
- To meet legal, accounting, or security obligations
We do not sell your personal information to third parties. We use a small number of service providers (such as our email and hosting providers) to operate the Site; they only receive the data needed to perform that function.
8.3 Your Rights & Choices
- Unsubscribe from the founding-client list at any time using the link in any email we send, or by contacting us.
- Request a copy of the personal information we hold about you.
- Request deletion of your personal information, subject to records we're legally required to keep.
- Correct inaccurate information by contacting us directly.
The Site is not directed at children, and we do not knowingly collect personal information from anyone under 16.
We may update this Privacy Policy from time to time; the "Last updated" date above reflects the most recent version.
